Welcome to FORME Movement. We’re grateful to have you as part of our community.

These Terms and Conditions (“Terms”) apply to your use of the FORME Movement website, application, and all related digital services (“Services”). By creating an account, accessing our platform, or using any of our Services, you agree to be bound by these Terms as well as our Privacy Policy.

If you do not agree with these Terms, you must stop using the Services immediately.

FORME Movement may update these Terms from time to time. Continued use of the Services indicates acceptance of any updated Terms.

1. DEFINITIONS

1.1 Application
 Any current or future version of the FORME Movement mobile app, website, or digital platform.

1.2 Services
 All online Pilates, strength, cardio, stretch, mobility, meditation, wellness content, challenges, programs, community features, and resources offered by FORME Movement.

1.3 FORME Movement
 A partnership operating under ABN 44 710 974 925, referred to as “we”, “our”, or “us”.

1.4 User / You
 Any individual accessing or using the Services.

1.5 Your Submissions
 Any content posted, uploaded, submitted, or shared by you through the Services, including comments, images, videos, messages, and profile content.

2. SERVICE ACCESS & ACCOUNT CONDITIONS

2.1 Registration Information
 You must provide accurate and complete information when creating an account and keep your details up to date.

2.2 Account Security
 You are responsible for maintaining the confidentiality of your username and password. You must not share, sell, or allow others to use your account.

Excessive login activity or suspicious behaviour may result in suspension or cancellation.

2.3 Acceptance of Terms
 By using any part of the Services, you accept these Terms in full.

2.4 Availability of Services
 We aim to provide consistent access, but availability is not guaranteed.

2.5 Technical Requirements
 You are responsible for ensuring your device, internet connection, and technology meet the requirements for using the Services.

2.6 Age Requirement
 You must be 18 or older, or have verified parental/guardian consent.

3. SUBSCRIPTIONS, BILLING & PAYMENT

3.1 Subscription Fees
 By subscribing, you agree to pay the fee stated at the time of purchase (“Subscription Fee”).

3.2 Auto-Renewal
 Subscriptions renew automatically unless cancelled prior to the renewal date.

3.3 Pricing
 All prices are listed in Australian Dollars (AUD) and may be subject to periodic review.

3.4 Payment Processing
 Payments may be processed through third-party providers. FORME Movement is not responsible for errors arising from external payment systems.

3.5 Failed Payments
 If payment cannot be processed, your subscription may be suspended or cancelled.

3.6 Refund Policy
 Subscription payments are non-refundable, except where required under Australian Consumer Law or at our discretion for long-term plans.

3.7 Cancelling a Subscription
 You may cancel your subscription via:

  • Your account settings (website purchases)

  • Apple/Google Play store (in-app purchases)

FORME Movement cannot cancel app-store subscriptions on your behalf.

3.8 Effect of Cancellation
 Cancellation takes effect at the end of the current billing cycle. You will retain access until that date.

4. LICENCE & PERMITTED USE

4.1 Licence Granted
 FORME Movement grants you a limited, non-transferable licence to access and use the Services for personal, non-commercial purposes only.

4.2 Prohibited Conduct
 You must not:

  • Record, copy, download, screenshot, or distribute content

  • Share access credentials

  • Use content for professional training or business activities

  • Interfere with, hack, or disrupt the Services

  • Upload harmful, illegal, or infringing content

4.3 Intellectual Property
 All videos, programs, branding, text, graphics, music, and materials remain the exclusive property of FORME Movement or its licensors.

5. SERVICE AVAILABILITY

5.1 No Guarantee
 While we aim for consistent service, uninterrupted access cannot be guaranteed.

5.2 Maintenance and Updates
 Access may be suspended temporarily for maintenance, updates, or security purposes.

5.3 Security
 Transmission of data through the internet is not completely secure. You acknowledge these risks.

6. THIRD-PARTY LINKS

6.1 External Websites
 The Services may contain links to third-party websites. We do not endorse or accept responsibility for external content.

6.2 Linking to FORME Movement
 You may link to our platform if:

  • It is done legally and fairly

  • It does not imply endorsement or affiliation

  • The linking site complies with these Terms

7. INTELLECTUAL PROPERTY & USER CONTENT

7.1 Ownership
 All intellectual property associated with the Services is owned or licensed by FORME Movement.

7.2 Your Submissions
 By uploading content, you confirm you own the rights or have permission to use the material.

7.3 Licence to Use Submissions
 You grant FORME Movement a licence to reproduce, distribute, modify, and display Your Submissions for operational, marketing, or promotional purposes.

7.4 Prohibited Content
 Your Submissions must not:

  • Violate copyright or privacy

  • Contain false or misleading statements

  • Be discriminatory, harmful, or inappropriate

  • Include advertisements or solicitations

7.5 Removal of Content
 We may remove Your Submissions at any time without notice.

7.6 Indemnity
 You indemnify FORME Movement from claims arising from Your Submissions.

8. MEDICAL DISCLAIMER

8.1 Not Medical Advice
 FORME Movement does not provide medical or physiotherapy advice.

8.2 Health & Safety
 Before beginning any exercise program, you must seek clearance from a qualified healthcare provider.

8.3 Pregnancy & Postpartum
 If you are pregnant, postpartum, or may be pregnant, you must obtain medical clearance before participating in any classes.

8.4 Exercise Risks
 Exercise carries inherent risks. By participating, you accept full responsibility for your health and wellbeing.

8.5 Stop If Unwell
 You must immediately stop if you feel dizzy, faint, unwell, short of breath, or experience pain.

9. GENERAL DISCLAIMER

9.1 Content Updates
 Content is subject to change without notice.

9.2 No Guarantees
 We do not guarantee that the Application is free from errors, defects, or malware.

9.3 Third-Party Content
 Opinions expressed by users or external contributors do not represent FORME Movement.

10. LIABILITY

10.1 Consumer Rights
 Nothing in these Terms excludes rights under Australian Consumer Law.

10.2 Limitation of Liability
 To the maximum extent permitted by law, FORME Movement is not liable for:

  • Injuries arising from exercise or use of the Services

  • Loss of data, revenue, or business

  • Misuse of the Application

  • Faulty or unsafe personal equipment

10.3 Your Responsibility
 You accept responsibility for your environment, equipment, and physical capability.

10.4 Indemnification
 You agree to indemnify FORME Movement for claims resulting from your misuse of the Services or breach of these Terms.

11. TERMINATION

11.1 Termination by FORME Movement
 We may suspend or terminate access at any time for misuse or breach.

11.2 Effect of Termination
 All rights granted to you end immediately.

11.3 Survival of Terms
 Clauses relating to liability, intellectual property, and privacy survive termination.

12. COMMUNICATIONS

You consent to receiving electronic communications from FORME Movement, including updates, notices, and service-related information.

13. GENERAL TERMS

13.1 Severability
 If any provision is invalid, the remaining Terms continue in effect.

13.2 Entire Agreement
 These Terms form the entire agreement between you and FORME Movement.

13.3 No Waiver
 Failure to enforce a right does not waive it.

13.4 Assignment
 You may not assign these rights without consent. We may assign our rights where appropriate.

13.5 Headings
 Headings are for convenience only.

14. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.
You submit to the exclusive jurisdiction of NSW courts.

15. GIFT VOUCHERS

15.1 Valid for 36 months from date of purchase.
15.2 Redeemable only via the FORME Movement website.
15.3 Not redeemable for cash.
15.4 Not replaceable if lost, stolen, or damaged.
15.5 Redeemable only for the specified subscription period.
15.6 Overrides current billing cycle upon redemption.
15.7 Not redeemable through Apple or Google Play subscriptions.
15.8 Only valid for users who created accounts on the FORME Movement website.
